1. Agreement to Terms

By accessing or using StudyCasper at https://www.studycasper.com (the "Service"), you agree to be bound by these Terms of Service. These Terms are a legally binding agreement between you and StudyCasper LLC, a Delaware limited liability company ("StudyCasper," "we," "us," or "our"), governing your use of the Service, including all content, functionality, and products offered. If you do not agree, you must discontinue use immediately.

We may update these Terms at any time. Changes become effective upon posting. Your continued use constitutes acceptance of any revisions. These Terms apply to all users, including visitors, customers, and subscribers.

2. Eligibility

You must be at least 18 years old to use the Service. The Service is intended for adults preparing for professional school admissions, and some scenarios record video of your face and voice. By using the Service, you represent that:

  • You are at least 18 years old
  • You have legal capacity to enter into a binding contract
  • You are not barred from using the Service under applicable law
  • All information you provide is accurate and complete

3. Accounts

To access certain features, you must register for an account. By creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your login credentials confidential and secure
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access

Accounts are for individual use only. You may not share access or use another person's account. We may suspend or terminate accounts at our discretion for violations or fraudulent conduct. StudyCasper is not liable for any loss arising from your failure to secure your account.

4. Fees and Payment

Certain features require payment. By purchasing, you agree to:

  • Pricing: All prices are in U.S. dollars and subject to change. Price changes do not affect existing subscriptions until renewal.
  • Payment Processing: Payments are processed securely through Stripe. We do not store complete credit card information on our servers.
  • Recurring Subscriptions: The weekly plan costs $39.99 and renews automatically every week until you cancel. You authorize us to charge the payment method on file at each renewal, at the then-current price, with no further action by you.
  • Cancelling a Subscription: You can cancel at any time from your account settings or the Stripe customer portal, or by emailing support@studycasper.com. Cancellation stops future renewals and takes effect at the end of the billing period you have already paid for; you keep access until then.
  • Taxes: You are responsible for applicable taxes. We may collect taxes where required by law.
  • Failed Payments: We may suspend access if payment fails. We are not responsible for fees charged by your financial institution.

5. Refund and Cancellation Policy

ALL SALES ARE FINAL. NO REFUNDS WILL BE PROVIDED EXCEPT AS EXPRESSLY STATED BELOW.

  • Weekly Subscription: First-time subscribers may request a full refund within 3 days of initial purchase. After 3 days, no refunds will be issued.
  • Lifetime Access: All lifetime purchases are final and non-refundable due to immediate delivery of digital content.
  • Cancellation: You may cancel subscriptions anytime via account settings or by contacting us. Access continues until the end of your billing period. No partial refunds for unused time.
  • Chargebacks: Initiating a chargeback may result in immediate account termination and pursuit of legal remedies. Fraudulent chargebacks may be reported to credit agencies.

6. Intellectual Property

All content on the Service—including text, graphics, logos, images, software, practice scenarios, questions, AI-generated feedback, and scoring methodologies—is owned by StudyCasper or its licensors and protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes. You may not:

  • Copy, distribute, or create derivative works of any content
  • Sell, license, or commercialize any content or access
  • Share content with third parties in any form
  • Remove or alter any proprietary notices
  • Use content to train AI or machine learning models
  • Use content to develop competing products or services

All AI-generated feedback and outputs are owned by StudyCasper. You may view and use them for personal educational purposes only. "StudyCasper" and related marks are our trademarks and may not be used without written permission.

7. User Content

You own the content you submit through the Service, including your practice responses, text answers, and video recordings. You grant us only the license we need to run the Service for you: a worldwide, royalty-free license to store, process, and display that content back to you, and to transmit it to the AI provider that generates your feedback. This license exists solely to deliver the Service to you and ends when the content is deleted.

We do not use your content to train or improve AI models, and we do not sell, license, or publish it. Our handling of video recordings, including when they are deleted, is described in our Privacy Policy.

You represent that your content:

  • Does not infringe any third-party rights
  • Does not contain defamatory, obscene, or illegal material
  • Complies with these Terms and applicable laws

We may remove content that violates these Terms, and we may access content where necessary to investigate a suspected violation, respond to a support request you make, or comply with a legal obligation. We do not otherwise review your submissions.

8. Prohibited Activities

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property or privacy rights of others
  • Share or sell account access or content to third parties
  • Scrape, mine, or automatically extract content
  • Use bots or automated tools to access the Service
  • Upload malware or harmful code
  • Attempt unauthorized access to systems or accounts
  • Interfere with or disrupt the Service
  • Harass, abuse, or defraud others
  • Circumvent security features or access controls
  • Post content on other platforms without authorization

We may investigate violations and take legal action, including account termination and civil or criminal penalties.

9. No Guarantee of Results

STUDYCASPER IS A PRACTICE TOOL ONLY. WE DO NOT GUARANTEE ANY SCORES, QUARTILE RANKINGS, OR OUTCOMES ON THE ACTUAL CASPER TEST.

Your performance depends on factors beyond our control, including your preparation, test-day conditions, and official scoring by Acuity Insights. StudyCasper is not affiliated with or endorsed by Acuity Insights or Altus Assessments. "Casper" is a trademark of Acuity Insights used for descriptive purposes only.

Testimonials represent individual experiences and are not guarantees of future results.

10. Third-Party Services

The Service may link to third-party websites and services, including payment processors (Stripe) and authentication providers. We have no control over and assume no responsibility for third-party content, policies, or practices. Use third-party services at your own risk.

11. Termination

We may suspend or terminate your access immediately, without notice, for any reason, including:

  • Violation of these Terms
  • Conduct harmful to the Service, users, or us
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees

Upon termination, your right to use the Service ceases immediately. No refunds will be issued. We may delete your account and data without liability. Provisions relating to intellectual property, disclaimers, liability, indemnification, and dispute resolution survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that results will be accurate or reliable, or that AI feedback reflects actual Casper test scoring. Your use is at your sole risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDYCASPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) AMOUNTS PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM, OR (B) $100.

Some jurisdictions do not allow these limitations. In such cases, liability is limited to the fullest extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless StudyCasper and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

15. Dispute Resolution

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution: Before filing any claim, contact us at support@studycasper.com. We will attempt to resolve disputes within 30 days.

Binding Arbitration: Unresolved disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be conducted in English, and any in-person hearing will take place in the county where you reside or, at your option, by videoconference.

Class Action Waiver: You and StudyCasper agree to bring claims only in individual capacity, not as a plaintiff or class member in any class, collective, or representative action.

Your Right to Opt Out: You may opt out of this arbitration agreement and the class action waiver by emailing support@studycasper.com with your name and the email on your account within 30 days of first accepting these Terms. Opting out affects nothing else in these Terms, and we will not close your account for doing so.

Exceptions: Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to prevent infringement of intellectual property rights.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Subject to the arbitration provisions above, you submit to the exclusive jurisdiction of the state and federal courts located in Delaware. Nothing in this section deprives you of the protection of any mandatory consumer protection law of the place where you live.

17. General Provisions

Severability: If any provision is held invalid, it shall be modified or severed to the minimum extent necessary. Remaining provisions continue in full force.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement and supersede all prior understandings.

Waiver: Failure to enforce any provision does not constitute a waiver of that or any other provision.

Changes: We may revise these Terms at any time. Material changes may be notified via email. Continued use constitutes acceptance.
